General Information.
CERTIFICATE OF COMPLIANCEIf you own a property which has a swimming pool, you may apply to the local authority for a Certificate of Compliance with respect to the swimming pool. You will need to complete an application and pay the prescribed fee. APPEALSAn appeal can be made against Council's decision. You may appeal to the Land and Environment Court within 28 days after the decision was made against the following: - a refusal to grant an exemption from safety restraint barriers where it is impracticable or unreasonable in a particular case (see "Impracticable Sites or Circumstances", under Exemptions;
- a decision to impose a condition on an exemption referred to in (a);
- a decision to give any direction to the owner of a swimming pool to take such measures so as to ensure the pool or premises comply with the requirements of the Act or of a condition referred to in (b); or
- a decision to refuse to grant a certificate of compliance.
PENALTIESIf you do not meet the conditions of the legislation, you could be given a penalty ranging from $30 to $1,000 per offense.
