Glossary of Terms

For the purpose of this information, please use the following definitions:
Barrier - means a fence or wall. It includes any gate or door set in the fence or wall. It can also include any other structure or thing which Council considers to be a barrier, for the purposes of this code.
Building - includes any structure or any part thereof.
Child Safe - in the case of a door, being of substantial construction and (when the door is locked, latched, bolted, chained or otherwise secured) having no opening below 1.5 metres above finished floor level (either in the door or between the door and the doorway), through which it is possible to pass a standard test bar; and
- in the case of a window, being of substantial construction and being so fixed (by means of a keyed locking device or other child resistant device) that it has no opening through which it is possible to pass a standard test bar; and
- in the case of wall being of substantial construction having vertical sides and having a height of at least 1.2 metres and (in the case of a wall which has above its top a gap of 105 millimetres or more) having no footholds wider than 10 millimetres within 1.1m of the top of the wall; and
- in any other case-being of substantial construction and having no opening through which it is possible to pass a standard test bar.
Dividing Fence - Has the same meaning as it has in the Dividing Fences Act 1991.
Dwelling - house
Existing Pool - a swimming pool whose construction or installation was begun on premises before 1 August 1990.
Fence - the assembly of components, natural or otherwise, which forms the intended barrier to the pool, not including any gates.
Note:The fence includes items such as posts and panels, constructed or natural walls, sides of buildings, balustrades or a balcony where they form part of the intended barrier. Fencing - a barrier comprising a fence and associated gate or gates
Fencing Height - the height perpendicular to the finished ground level at any point along the length of the fencing, measured on the outside of the fencing. (Figure 2)
Gate - any portion of the fencing that is designed to provide entry through the intended barrier.
Inside of the Fencing - that side of a fence or gate facing the pool area
New Pool - a swimming pool whose construction or installation was begun on premises on or after 1 August 1990.
Outside of the Fencing - that side of a fence or gate which faces away from the pool area
Pool Area - the area immediately surrounding a pool, in which the activity related to the use of a pool generally takes place
Pool Side Structure - includes diving boards, pool filtration units, outdoor furniture settings, barbecues and the like.
Splasher Pool or Wading Pool - any privately owned structure capable of being filled with water to a depth of less than 300mm and intended to be filled with water before use and emptied and stored after use.These pools are used by very young children for splashing and playing under supervision.
Standard Test Bar - means a round bar having a diameter of 105mm, plus or minus 1mm.
Swimming Pool - means an excavation, strucure or vessel.
- that is capable of being filled with water to a depth of 300mm or more; and
- that is used, or designed, manufactured or adapted to be mainly used, for the purpose of swimming, wading, paddling or any other human aquatic activity.
and includes a spa pool, but does not include a spa bath, and anything that is situated within a bathroom.
The Act - refers to the Swimming Pools Act 1992.
You - a person or persons who owns or occupies premises on which a swimming pool is, or is about to be located.
Young Child - a child under the age of five years.
