Planning Proposal to Amend Dungog LEP 2014

Pursuant to Sections 3.34(2)(c)  and Schedule 1 Clause 4 of the Environmental Planning and Assessment Act 1979, notice is thereby given of the public exhibition of a draft Local Environmental Plan (LEP) to amend subclause (3)(f) of Clause 4.2A Erection of dwelling houses and dual occupancies on land in certain rural and environment protection zones, of Dungog Local Environmental Plan 2014.

The draft Planning Proposal seeks to enable an ‘existing holding’ to be modified by a minor realignment of its boundaries (no new lots created), or modified through a subdivision or consolidation with adjoining land for a public purpose, without extinguishing a dwelling entitlement.

The draft Planning Proposal and Gateway Determination will be on public exhibition from Wednesday 27 February 2019 until Thursday 14 March 2019 during ordinary business hours at the following locations:

•    Dungog Public Library, 17 Mackay Street, Dungog
•    Clarence Town Rural Transaction Centre, 116 Prince Street, Clarence Town  
•    Gresford Post Office Store, 162 Durham Road, Gresford  
•    Vacy General Store, 803 Gresford Road, Vacy  
•    Paterson Country Café & Store, 24 King Street, Paterson 

Persons wishing to comment on the draft Planning Proposal should do so in writing addressed to the General Manager, Dungog Shire Council, PO Box 95, DUNGOG NSW 2420. Submissions should be received no later than 4.30 pm Thursday 14 March 2019 and should quote reference number RA171/82/45.

In accordance with Section 3.34(2)(g) Council has not sought nor has been given the delegation to make this local environmental plan.

In accordance with the Local Government and Planning Legislation Amendment (Political Donations) Act 2008, any person making a written submission after 1 October 2008 - either for or against a proposal - must also make a disclosure if the person has made a reportable political donation.

If relevant, please include a completed "Political Donations Disclosure Statement" form with your submission. This form can be found on Council's website at or obtained from Council's Customer Service Counter.
