Infrastructure Contributions

Sections 7.11 and 7.12 (former Section 94 and Section 94A) of the Environmental Planning and Assessment Act 1979 (EP&A Act), enables councils or other consent authorities to levy contributions of land or money for the provision, extension or augmentation of public amenities and services that may be required due to development.

Contributions plans divide the cost of works generated by demand from development by the population to establish a reasonable contribution rate. The EP&A Act Regulation 2000 requires that a contributions plan identify the relationship, or nexus between the expected development and the demand for the infrastructure. The cost of infrastructure that will benefit all the LGA residents is shared between the existing and new demand.
